Customs Border Protection (CPB) Automated Commercial System (ACS) Reconciliation Prototype filing deadline changes

The Customs ACS Reconciliation prototype program allows revisions to certain elements of an entry summary that cannot be determined at time of entry. Subsequent post entry revisions or no changes that address the outstanding issues must be processed and filed on a Reconciliation entry within the allotted time frame.

The President signed into law the Miscellaneous Trade and Technical Corrections Act of 2004 on 12/3/2004.

Under Subtitle B- Section 2101 this act made changes to Reconciliation entry filing deadline as follows:

Effective 30 days after publication in the Federal Register, the filing date for the Value/9802/HTS Reconciliation Entry is within 21 months after earliest entry summary date.

The Reconciliation Entry must be filed within 15 months (current procedure) for entry summaries filed prior to the 30 day Federal Register publication.

The Reconciliation filing due date will be based on earliest entry summary date plus 15 months for Reconciliation entries made with underlying entries having mixed due dates.

This change does not affect entries flagged for NAFTA-North American Free Trade Agreement or CFTA-US-Chile Free Trade Agreement issues. For these issues the Reconciliation filing due date remains within 12 months of import date.
