Alert: Final AES Notification -- Option 4 Privileges

Please consider this the final notification of the AES deadline regarding the ability of a USPPI (U.S. Principal Party in Interest) to file a LOI (Letter of Intent) to get Option 4 privileges. USPPI is in most cases the actual exporter, but may be another party in cases of drop-shipment programs, or other third-party transactions.

Only those LOIs postmarked or faxed dated prior to Friday, August 15th will be accepted.

If your company can benefit from this information please read the AES broadcast noted below.

As stated in this broadcast, there will be a post departure program that will be put into place next year when the pre-file of export information rules take effect, but it will be different. The criteria may be much different and having a "grandfather option 4 status" could be very beneficial.

Please note that as of August 15, 2003 the U.S. Census Bureau, along with partnership agencies, U.S. Customs and Border Protection, Bureau of Industry and Security, and the Office of Foreign Assets Control will no longer accept letters of intent (LOI) for the AES Post-Departure Filing Program known as AES Option 4. AES Option 4 grants USPPI's or exporters the privilege of filing their commodity data up to 10 working days after the date of export. The acceptance of LOIs is being suspended due to upcoming changes in the regulations.

Any AES Option 4 LOI postmarked or facsimile time stamped after August 15th will not be reviewed for the AES Option 4 filing privilege. Option 4 LOIs received prior to the deadline will still be reviewed by the partnership agencies. Companies interested in Option 4 after the August 15th deadline, will be able to submit an Option 4 LOI once the new regulations for Mandatory AES are released in mid-2004. If you are now an active AES Option 4 filer, this change will NOT affect you.
